PostSubject: Final Rules   Thu Aug 09, 2007 9:49 am

Hi everyone....

1. All masters must be the original work of the member submitting them.

2. By submitting a master the owner of it's rights grants the HAAUK CMP non-exclusive rights, for a period of 5 years from the date of submission, to produce casts, moulds and other derivatives for distribution to the members of the HAAUK.

3. By submitting a master the owner of it's rights grants HAAUK CMP members non-exclusive rights, to produce casts, moulds and other derivatives, for their own personal use. Business use is excluded.

Please let me know what you all think about these rules?

Thanx

Neil.

Hi sorry I couldn't get back to you yesterday. Life intruded.

One very small change that should avoid future problems

1. HAAUK CMP should be changed to HAAUK. The reasons for this are that -
a) All CMP members must be members of HAAUK
b) The CMP is only a sub-group of the HAAUK
c) 'CMP' itself is only a working title and may change.

There should be a 'rule' in the basic governing documents that 'all references to HAAUK should be taken to include it's successors and/or changes of name'.

These are the three main rules governing the way masters, casts and moulds are dealt with. Things like costs are decided as a management concern and may change from time to time.

The more I think of it these are the only specific rules needed by the CMP - all other rules are those of the HAAUK.

Any questions please ask - at the moment we are all sorting things out behind the scenes, the best we can. Things do take time to organise.

All the best

Jon

Newly demoted from member to Chair/Secretary of the CMP. Yes you did read that right - a clubs members are far more important than titles.farao

Hi everyone....

fox, cheers you have made some very good points there. I will include these in the final rules.

Please let me know what you all think about these rules?

Thanx

Of course the post above should now read -

1. HAAUK CMP should be changed to SABA. The reasons for this are that -
a) All CMP members must be members of SABA
b) The CMP is only a sub-group of the SABA
c) 'CMP' itself is only a working title and may change.

I think everybody still agrees?

All the best

Jon

The 'rules' now read -

1. All masters must be the original work of the member submitting them.

2. By submitting a master the owner of it's rights grants SABA non-exclusive rights, for a period of 5 years from the date of submission, to produce casts, moulds and other derivatives for distribution to members of SABA.

3. By submitting a master the owner of it's rights grants SABA members non-exclusive rights, to produce casts, moulds and other derivatives, for their own personal use. Business use is excluded.

I hope that this satisfies the majority. I realise that the sculptors are being very generous to the members. Fortunately we have a skilled group who are prepared to put the benefits of all members above personal gain. I am sure that all members join me in expressing my thanks to them.

I would like to amend Rule 1, just to make things absolutely crystal clear:

1. All masters must be the original work of the member submitting them. By submitting work to this association, a member will be deemed to have claimed that the copyright to such works, belongs to him. The association will not accept responsibilty for any claims of copyright infringement. Any such action will be redirected towards the member who contributed the offending pieces.

The first addition is a restatement of the rule. It could be included in an explanation but doesn't belong in the rule itself.

The second addition is not possible in English and Welsh Law. It just isn't the choice of somebody being sued to pass on the litigation. The claimant makes their choice.
